1.5 Jak mogę dodać prawnika do mojego wniosku lub go zmienić?

Nie, prawnik nie jest konieczny do złożenia wniosku do VCF i wnioski złożone przez prawników nie są traktowane priorytetowo w stosunku do tych, które zostały złożone bez reprezentacji prawnika. El VCF no recibe copia de su récord médico como parte del acuerdo de compartir información con el Programa de Salud del WTC. El Programa de Salud del WTC solo le provee al VCF la información que se usa para determinar si usted tiene una condición elegible certificada. La información que recibimos del Programa de Salud del WTC incluye, nombre de la condición, la categoría de la condición dentro del Programa de Salud del WTC (por ejemplo, cáncer, desorden en las vías respiratorias superiores), y el código del diagnóstico médico asociado.

Sí, aunque, al VCF se le requiere por ley contrarrestar cualquier beneficio pagado por cualquier fuente colateral en relación a los ataques del 11/9. No, usted no necesita un abogado para presentar un reclamo con el VCF, y no se le da prioridad a los reclamos que son presentado a través de abogado sobre los reclamos presentados sin abogados. 3.2 Does the VCF receive copies of my medical records from the WTC Health Program? Do I need to submit them with my claim?

The VCF does not receive copies of your medical records as part of our information-sharing agreement with the WTC Health Program.  The WTC Health Program only provides the VCF with information that is used to determine whether you have an eligible, certified condition.  The information we receive from the WTC Health Program includes the name of the condition, the WTC Health Program category under which the condition falls (for example, Cancer or Upper Respiratory Disorder), and the associated medical diagnosis code.  If the WTC Health Program notifies us that you have been certified

3.1 Is the WTC Health Program part of the VCF?

No, the VCF and the WTC Health Program are two separate programs, each of which has its own registration process, eligibility criteria, and mission. The WTC Health Program is administered by the U.S. Department of Health and Human Services and provides medical monitoring and treatment for responders to the WTC and related sites in New York City, the Pentagon, and Shanksville, PA; and for survivors who were in the WTC Health Program’s New York City Disaster Area during the required timeframe.

1.10 Can I pursue a claim with both the VCF and the U.S. Victims of State Sponsored Terrorism Fund (“USVSST Fund”)?

Yes, however, the VCF is required by law to offset any benefit paid by other collateral sources relating to the 9/11 attacks. As a result, USVSST Fund payments made to victims who are also eligible for compensation from the VCF, will be subject to offset by the VCF. To be clear, the VCF is required to offset USVSST Fund payments made on account of 9/11-related injuries to the same victim.

1.5 How do I add or change the attorney on my claim?

To add, change, or remove the attorney on your claim, follow the instructions on the Change of Attorney Form and upload the completed and signed form to your claim.  Once the VCF receives the completed form and any required documents, we will make the appropriate updates to your claim, including who receives correspondence and who is able to access the claim online.

1.4 Do I need a lawyer to file a claim?

No, you do not need an attorney to file a VCF claim, and there is no priority given to claims submitted by an attorney over those without an attorney.  We evaluate all claims following the same guidelines and calculate all awards using the same methodology, regardless of whether an attorney is assisting with the claim.

Dear Claimants,

The September 11th Victim Compensation Fund has updated the Personal Injury and Deceased Individual claim forms to include the types of cancer that NIOSH has added to the list of WTC-Related Health Conditions. The updated forms are now available online through the Claims Management System.

You will find the eligible types of cancer listed in Part III of the claim form. Please see FAQ 3.21 for details on how to add cancer to your existing claim.

根据VCF的要求,如果您在2012年10月12日或之前,知道(或理应知道),身患被涵盖的癌症,您必须在2014年 10月12日之前提交您的索赔,以便让VCF进行审议。如果您在2012年10月12日后才知道患有被涵盖的癌症 ,那么,您必须在知道(或理应知道)患有被涵盖癌症之日起,两年之内,提交索赔,以便让VCF进行审议。例 如,如果您在2012年5月1日知道您患有被涵盖的癌症,您将必须在2014年10月12日前提交您的索赔。但是,如 果您在2013年1月1日知道您 患有被涵盖癌症,您将必须在2015年1月1日前提交您的索赔。

“正如我先前所说,9/11受害人赔偿基金(VCF)基金将会遵循由负责世界贸易中心健康计划(健康计 划)运作的国家职业安全和健康研究所(NIOSH)的医生和科学家所主持进行的医学分析。如果个别 人士已确诊患有现已增添进健康计划中的其中一种癌症,该癌症根据健康计划制定的标准,被确定为因 9/11恐怖袭击所造成,同时,这些人士必须满足VCF的其它资格条件,那么,他们将有资格获得VCF赔 偿。这些标准包括,证明在2001年9月11日至2002年5月30日期间,身在坠机现场之一;证明特定的身 体状况是因恐怖相关坠机事件或坠机现场的残骸清理直接造成;以及证明身体伤害从被发现之日起,在 合理的时间内,得到医疗专业人员的治疗。”
